USE OF LOCAL SICK LEAVE

Local sick leave may be used for the following reasons:

1. One day’s absence to attend a member of the employee’s
f   family during normal childbirth. Complications from childbirth
    shall be considered illness in the family.

2. One day’s absence for death of a relative not in the immediate
    family, defined as aunt, uncle, niece, nephew, or first cousin by
    blood or marriage.

3. Up to five days for adoption of a child under two years of age.

OTHER ABSENCES

The Superintendent or designee may approve requests to be absent without loss of state or local sick leave for the following additional reasons:

1. With pay for:

    a. Attendance at professional or instructional meetings, provided that the    
        employee is a member of the sponsoring organization and a valid 
        school-related purpose will be accomplished by such attendance, or that 
        the employee is requested to attend by the District. (See DGA)

    b. Jury duty.

    c. Summons to appear in court as a witness.

    d. Summons to appear before the income tax board.

2. Without pay for attendance at professional or instructional meetings if the 
    conditions in "a" above are not present.

Non-administrative employees appearing on behalf of the District in a legal action occurring on a day that is not a scheduled work day may be compensated by the District. Such compensation shall consist of compensatory time, if the employee’s work schedule permits, or, if not, monetary compensation based upon that employee’s hourly or daily rate, as appropriate.

The certified employee on temporary disability leave of absence shall receive all monies that had been held by the district for the purpose of payroll checks that would have been received during the summer months.

RETURN TO DUTY

The certified employee shall submit a written request to the Associate Superintendent of Human Resources of a desire to return to active duty at least 30 days before the expected date of return. The notice must include a physician’s statement indicating that the employee is physically fit to return to regular duties.

If the certified employee returns from the temporary leave of absence, the salary for the remainder of the school year will be the daily rate multiplied by the number of days remaining, divided by the number of pay periods remaining.

RETURN FROM LEAVES OF ABSENCE

When returning from a leave of absence, an employee shall observe the following procedures:

1. Employees on temporary disability or leaves must request to return in writing 
    at least thirty days before the anticipated date of return. Employees on 
    developmental leaves must request to return in writing at least forty-five days 
    before the beginning of the term in which they wish to return.

2. Employees returning from temporary disability leaves must submit to the 
    personnel office a physician’s statement of fitness to return to work. The 
    employee’s pay may be suspended until such a statement is received.

3. If an employee has not requested a return from any type of leave within 365 
    days of its beginning, the employee shall be terminated.

4. If the employee has not worked full time outside the District during the leave, 
    accumulated sick leave shall be restored. If the employee works full time while 
    on leave, employment with the District shall be subject to termination.
